Terms of Service

These Terms of Service ("Terms") govern your use of the website at loanr.app and the applications and services operated by Loanr Inc. ("Loanr," "we," "us," or "our"). By accessing our website, creating an account, or using any Loanr application, you agree to these Terms. If you do not agree, do not use the service.

1. What Loanr does

Loanr operates a managed loaner vehicle platform. We source vehicles from independent vehicle hosts, arrange insurance coverage for program activity, and place those vehicles at participating repair shops on a subscription basis. Participating shops check vehicles out to their own customers while those customers' vehicles are being serviced. Loanr is a platform operator and program administrator. Loanr is not a rental car company, an insurance company, or a repair facility.

2. Eligibility

You must be at least 18 years old to use the Loanr platform. If you are using the platform on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been accessed without authorization. You agree to provide accurate and current information and to keep it updated.

4. Repair shops

If you subscribe to Loanr as a repair shop, you agree to:

  • Store assigned vehicles securely at your facility

  • Verify driver identity and eligibility before releasing a vehicle

  • Complete checkout and return workflows through the Loanr applications, including condition documentation

  • Maintain vehicle cleanliness and report maintenance needs

  • Report incidents, damage, and accidents promptly

  • Make vehicles available for scheduled rotation

  • Pay subscription fees as they come due

Shops do not own assigned vehicles and may not sell, sublease, encumber, or permanently relocate them.

5. Vehicle hosts

If you supply a vehicle to the Loanr network, you agree to:

  • Provide accurate information about the vehicle, including its condition, mileage, and history

  • Maintain valid registration and title

  • Perform maintenance outside of normal wear items

  • Make the vehicle available for placement, rotation, and retrieval as scheduled

  • Meet the eligibility standards we publish for vehicle age, mileage, and condition

Compensation terms, payout schedules, and program requirements are set out in your host agreement.

6. Drivers

If you borrow a loaner vehicle through a participating repair shop, your use of that vehicle is governed by the loaner agreement you sign at checkout. That agreement controls in the event of any conflict with these Terms. The Loanr Driver web application is provided for your convenience as a reference for trip details, vehicle documents, and support information. Access is provided through a link tied to your specific loaner transaction and expires after your vehicle is returned. The documents displayed in the Driver application are provided for reference. You are responsible for carrying the physical registration and insurance documents kept in the vehicle.

7. Insurance

Loanr arranges commercial insurance coverage for program activity. The scope, limits, exclusions, and conditions of that coverage are governed entirely by the applicable insurance policy and any certificates issued under it, not by these Terms or by any description on our website or in our applications. Nothing in these Terms constitutes a promise of coverage for any particular loss. Coverage determinations are made by the insurance carrier.

8. Fees and payment

Subscription fees, deposits, and any other charges are described at the time of purchase. Payments are processed by a third-party payment processor, and your use of that processor is subject to its own terms. Unless stated otherwise in writing, subscription fees are billed in advance and are non-refundable. Deposits are handled according to the terms disclosed when the deposit is collected.

9. Acceptable use

You agree not to:

  • Use the platform for any unlawful purpose

  • Misrepresent your identity or your authority to act on behalf of a business

  • Falsify vehicle condition records, mileage, fuel levels, or incident reports

  • Interfere with, disrupt, or attempt to gain unauthorized access to the platform

  • Scrape, reverse engineer, or copy any part of the platform

  • Use the platform to collect information about other users

10. Text messages

Loanr sends transactional text messages in connection with loaner vehicle transactions. Our messaging program is described in full in our Messaging Terms, which are incorporated into these Terms by reference. Message and data rates may apply. Reply STOP to opt out.

11. Intellectual property

The Loanr platform, including its software, designs, logos, and content, is owned by Loanr and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable license to use the platform for its intended purpose while your account is active.

12. Third-party services

The platform relies on third-party services for hosting, payments, messaging, mapping, and other functions. We are not responsible for the availability, accuracy, or practices of those services.

13. Disclaimers

The platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Loanr disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or secure, or that vehicle availability, status information, or documents displayed in the platform will be accurate at all times.

14. Limitation of liability

To the fullest extent permitted by law, Loanr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business, arising out of or related to your use of the platform. Our total liability for any claim arising out of or related to these Terms will not exceed the greater of the amounts you paid to Loanr in the twelve months preceding the claim, or one hundred dollars. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Loanr and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the platform, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Termination

We may suspend or terminate your access to the platform at any time if you violate these Terms or if we discontinue the service. You may stop using the platform at any time, subject to any separate subscription or host agreement you have entered into.
